The role of international law in regulating the use of international rivers (Study of the legal status of the Tigris and Euphrates rivers)

Abstract

 

This research sheds light on the issue of the use of international rivers and the legal problems it poses as a result of relations between riparian countries and the results of those uses. To formulas of cooperation between states in accordance with the provisions of public international law.

By studying the issue of dividing the waters of international rivers between countries, we touched on the most important jurisprudential theories related to the division of water. In its territory, while restricting it to the obligation to respect the interests and rights of other riparian countries to benefit from and benefit from the waters of international rivers, given that the international river constitutes a single unit from its source to its mouth.

The legal status of the Tigris and Euphrates rivers was studied, as Turkey still considers the Euphrates to be unaffected by international law as "transboundary waters and not an international river." Based on that, it established its water projects without consulting with its neighbors from the basin countries (Syria and Iraq). Thus, it undermined the principle of equal common rights for the basin countries.
