تسوية المنازعات بين الشركة المتعددة الجنسيات والدول المضيفة

Abstract

This research deals with the subject of investment disputes that may arise between the multinational company and the host countries settlement, although great care of by this company on the understanding with the host country on all issues and matters that may arise in connection with the implementation of the investment project, but that a lot of investment disputes that may arise between them, which calls for the need to be solved, and there are multiple legal means to resolve these disputes in a friendly means The negotiations, conciliation, mediation and judicial means and is in arbitration,the national judiciary, the international judiciary, international conventions, so we will study the judicial means only with reference to the comparison of investment laws, which took them to get in end to a set of findings and recommendations. One of the main conclusions that have been reached: some host countries, especially developing prefer not to resort to commercial arbitration to resolve investment disputes in addition to the non-recourse to national judiciary as a means to resolve investment disputes. But are investment dispute settlements through international conventions. This research was conducted in the city of Damascus, and took months to prepare. يتناول هذا البحث موضوع تسوية المنازعات الاستثمارية التي قد تنشب بين الشركة المتعددة الجنسيات والدول المضيفة، فعلى الرغم من الحرص الكبير من قبل هذه الشركة على التفاهم مع الدولة المضيفة على جميع المسائل والأمور التي قد تنشأ بصدد تنفيذ المشروع الاستثماري, إلَّا أن كثيرا من المنازعات الاستثمارية قد تنشأ بينهما مما يستدعي ضرورة حلها. ويوجد وسائل قانونية متعددة لحل هذه المنازعات وهي الوسائل الودية وتتمثل بالمفاوضات والتوفيق والوساطة, والوسائل القضائية وتتمثل في التحكيم والقضاء الوطني والقضاء الدولي والاتفاقيات الدولية، لذا سوف نقوم بدراسة الوسائل القضائية فقط مع الإشارة إلى قوانين الاستثمار المقارنة التي أخذت بها لنصل في النهاية إلى مجموعة من النتائج والتوصيات. ومن أهم النتائج التي تم التوصل إليها: أن بعض الدول المضيفة, وخصوصاً النامية, لا تفضل اللجوء إلى التحكيم التجاري لحل منازعاتها الاستثمارية, إضافة لعدم اللجوء إلى القضاء الوطني بوصفه وسيلة لحل المنازعات الاستثمارية. وأن يتم تسوية المنازعات الاستثمارية عن طريق الاتفاقيات الدولية. تم إجراء هذا البحث في مدينة دمشق واستغرق شهراً لإعداده.
