Abstract

يتناول هذا البحث التحكيم في عقود الاستثمار الدولية واهميته في المرحلة الحالية من اعادة اعمار سورية.

لقد اصبحت عقود الاستثمار من اهم مرتكزات التنمية الاقتصادية تعتمد عليها الدول والمؤسسات والافراد في سبيل تحقيق مصالحهم التجارية.

يركز هذا البحث على مفهوم الاستثمار كوسيلة مهمة في جميع المجالات التجارية والصناعية والزراعية والسياحية وكافة قطاعات الخدمات. كما يستعرض اهم انواع عقود الاستثمار التي تبرمها الدول مع الشركات التي يلتزم من خلالها المستثمر الاجنبي بنقل قيم اقتصادية للدول المضيفة.

وبما ان التحكيم والاستثمار توأمان لا يمكن الفصل بينهما يستعرض البحث اهمية اللجوء الى التحكيم ومؤسساته الاقليمية والدولية. كما يركز على كيفية ضمان فعالية التحكيم في عقود الاستثمار الدولية.

وقد تم التأكيد في هذا البحث على اهم قوانين وتشريعات التحكيم في الجمهورية العربية السورية في المرحلة الحالية التي تشهدها سورية في مجال اعادة الاعمار.

This article aims at studying the importance of arbitration in international investment contracts. A special focus will be on The Syrian regulations and laws concerning investment and arbitration.

In the first section the article clarifies and discuss investment contracts which are necessary tools for states, and companies for economic development. The analysis will cover the basics of all investment contracts and some of the most important contracts in different commercial, industrial, agricultural, and service sectors.

The second section of the article deals with international arbitration as an important instrument to solve all disputes arising out of investment contracts.

Finally, special attention will be paid to the Syrian laws and regulations that are initiated to deal with the new coming stage of Syria's reconstruction.
