دعوى صحة ونفاذ عقد القسمة الرضائية

يعد عقد القسمة الرضائية الطريق الرئيسي لإنهاء حالة الشيوع ، فمن خلال هذا العقد يتمكن كل شريك في المال الشائع من الحصول على جزء مفرز يعادل ما له من حصة شائعة فيه.
وقد بحث أغلب الفقه في هذا العقد ، في معرض شرح أحكام الملكية الشائعة إلا أن الدراسات المتعقلة بدعوى صحة و نفاذ عقد القسمة الرضائية كانت نادرة وأغلبها لم تكن متخصصة.
ويهدف هذا البحث إلى تحديد الأساس القانوني لهذه الدعوى و الذي يتناسب مع عقد القسمة الرضائية - كعقد محدد للملكية وكاشف لها - وتمييزها عما يشتبه بها من دعاوي تستند الى عقود ناقلة للملكية كالبيع أو المقايضة.
وبعد ذلك ننتقل إلى بيان شروط هذه الدعوى وإجراءاتها للوصول إلى دراسة قانونية جامعة بالحد الممكن في هذا الموضوع.
Consensus is the main way to end the state of condominium. Through this contract, each partner in the common property (estate) can obtain a part of the share that is equal to the common share.
Most writings or opinions of jurists (jurisprudence) have discussed this contract in the explanation of common property provisions, but the studies concerning the validity and enforceability of the consensual division were rare and most were not specialized.
This research aims at determining the legal basis of this lawsuit and is suitable for the Consensus Division as a contract determining the ownership and disclosing it and not as transferor (assignor) of ownership. It also distinguishes it from similar lawsuits ( claims) that based on property transferring contracts such as sale or barter.
After that, we turn to demonstrating the conditions of this lawsuit and its procedures in order to reach a comprehensive legal study of this subject as possible.
