The Legal Importance Of Palestine's Accession To The International Criminal Court

Abstract

This paper discusses the consequences of the accession of Palestine to the International Criminal Court to stand on the most important points of law on this subject, in particular those concerning the scope of the Court's jurisdiction to consider the Israeli crimes in the Palestinian territories, and the extent of Israel's commitment to cooperate with it in its investigation even though It is not a state party to the charter.

It also deals with this research study supplementary jurisdiction of the Court and the relationship with the Security Council, reckoning that these things if they were from which politicize the work of the Court will serve as an one of the most prominent legal obstacles that may face jurisdiction to consider the Israeli crimes.

We will try through this research shed light on the previous topics through the following two requirements:

-       First requirement: the scope of the Court's jurisdiction in the Israeli crimes and the extent of Israel's commitment to cooperate with it.

-       The second requirement: Legal loopholes in the Court's Charter that may prevent it from considering Israeli crimes.

 

يناقش هذا البحث النتائج المترتبة على انضمام فلسطين إلى المحكمة الجنائية الدولية للوقوف على أهم النقاط القانونية المتعلقة بهذا الموضوع، سيما تلك المتعلقة بنطاق اختصاص المحكمة بالنظر في الجرائم الإسرائيلية على الأراضي الفلسطينية، ومدى التزام إسرائيل بالتعاون مع المحكمة فيما تقوم به من تحقيقات على الرغم من أنها ليست دولة طرف في ميثاقها.

كما يتناول هذا البحث دراسة الاختصاص التكميلي للمحكمة،  والعلاقة التي تربطها بمجلس الأمن بحسبان أن هذه الأمور إذا ما تم من خلالها تسيس عمل المحكمة، قد تشكل أحد أبرز العقبات القانونية التي تواجه اختصاصها بالنظر في الجرائم الإسرائيلية.

وسنحاول من خلال هذا البحث تسليط الضوء على الموضوعات السابقة من خلال المطلبين التاليين:

 

-      المطلب الأول: نطاق اختصاص المحكمة بالنظر في الجرائم الإسرائيلية ومدى التزام إسرائيل بالتعاون معها.

 

-      المطلب الثاني: الثغرات القانونية في ميثاق المحكمة التي قد تحول دون نظرها في الجرائم الإسرائيلية.
