La Role Du Lex Mercatoria En L Arbitrage Commercial International
Abstract
L'une des principales caractéristiques de l'arbitrage commercial international tient au fait que ses règles tiennent fortement compte des utilisations du commerce international dans le règlement du différend confié aux arbitres. L'article 29-4 de la Loi type de la CNUDCI, par exemple, oblige le tribunal arbitral à statuer dans tous les cas "conformément aux termes du contrat" et à prendre en compte "les normes commerciales applicables qui régissent la transaction".
Les normes du commerce international font partie des sources du droit commercial international qui ne reflètent aucun système juridique gouvernemental et sont communément appelées lex mercatoria.
Le respect des normes commerciales internationales dans le règlement des différends soulève principalement le problème de leur capacité à contrôler efficacement les conflits. Si cette capacité est démontrée, le deuxième problème se pose quant à la mesure dans laquelle les normes fonctionnent dans l'arbitrage commercial international.
