Abstract

In the past, the ship symbolized the marine mechanism that roamed the seas and oceans for the purpose of trade and transportation of people and goods, it has become nowadays in many forms and performs a variety of tasks, which calls for a precise definition.The research deals with the ship as an important and effective element that has a vital role in international maritime commercial transport operations, which has resulted in It has become the backbone of marine navigation. The research reviews the definition of the ship from the point of view of international convention National legislation and international jurisprudence opinions, in addition to shedding light on the legal and subjective nature of the offshore facility, which It gives it a description of the ship, indicating the types of ships and distinguishing it from other similar marine installations. As research aims to clarify the rights contained on the ship from ownership, mortgage and seizure, while specifying the legal position of the ship in the maritime areas subject to sovereignty. The research reached many results, the most important of which are:1-           There is a contradiction between international conventions, national legislation, and international jurisprudence opinions about defining the concept of a ship.2-           The Jamaica Agreement of 1982 divided the sea into different maritime zones. This division resulted in regulating the legal status of the ship while in these areas.3-           Assuming that the ship is a movable property of a special nature, it has become a place because some of the rights contained in the property, such as mortgage, seizure and insurance, are returned to it.
